1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the GetGrowth platform, website, APIs, and all related services (collectively, the "Service") provided by Block and Byte Technologies Pvt Ltd ("GetGrowth", "we", "us", or "our"), a company incorporated in India.

By creating an account, clicking "I agree", or otherwise accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you are using GetGrowth on behalf of a company, organisation, or other legal entity, you represent that you have the authority to bind that entity to these Terms, and the terms "you" and "your" refer to that entity.

If you do not agree to these Terms, you must not access or use the Service.

2. Definitions

"Service" The GetGrowth platform, website (getgrowth.me), mobile experiences, APIs, and all features therein.
"Account" Your registered GetGrowth profile, including credentials, settings, and connected platforms.
"User Content" Any content you upload, input, or create through the Service — including posts, product info, persona prompts, and templates.
"Generated Content" Any posts, replies, messages, or copy produced by GetGrowth's automation on your behalf using AI or rule-based logic.
"Connected Platform" A third-party social media service you authorise GetGrowth to access — Instagram, Facebook, WhatsApp, YouTube, or LinkedIn.
"Subscription" A recurring paid plan (Starter, Creator Pro, or Agency) granting you access to Service features as described on the pricing page.
"Audience Member" A follower, commenter, or contact of yours whose data is processed through GetGrowth automations.
"Automation" A configured workflow within GetGrowth that triggers actions (replies, DMs, posts, lead capture) based on defined conditions.

3. The Service

GetGrowth is a social media automation and revenue platform that enables content creators, brands, and businesses to automate engagement, lead generation, content publishing, and sales across Instagram, Facebook, WhatsApp Business, YouTube, and LinkedIn.

Key capabilities include but are not limited to:

  • Automated comment and DM replies across connected platforms
  • AI-assisted post generation and scheduled publishing
  • Keyword-triggered lead capture and WhatsApp sales sequences
  • Digital product delivery and payment processing via Cashfree
  • Contact CRM for audience and lead management
  • Analytics dashboards for engagement and revenue tracking

We reserve the right to modify, enhance, or discontinue features at any time. We will provide reasonable notice for material changes that affect paid functionality. The Service is provided "as a service" — you access it over the internet and do not receive any software to install locally.

4. Eligibility & Account Registration

4.1 Age Requirement

You must be at least 18 years of age to create an account and use the Service. If you are between 13 and 17, you may use the Service only under the direct supervision of a parent or legal guardian who accepts these Terms on your behalf. We do not permit accounts for children under 13 under any circumstances.

4.2 Business Users

If you register as or on behalf of a business entity, you warrant that the entity is duly incorporated or formed, is in good standing under applicable laws, and you are authorised to enter into these Terms on its behalf.

4.3 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to keep your account information updated at all times. Providing false, misleading, or fraudulent information is grounds for immediate account termination.

4.4 Account Security

  • You are responsible for maintaining the confidentiality of your login credentials
  • You must not share your account with others or allow third parties to access it on your behalf without using our team member features
  • You must notify us immediately at admin@getgrowth.me if you suspect unauthorised access to your account
  • We recommend enabling two-factor authentication (2FA) for your account
  • We are not liable for any loss or damage arising from unauthorised account access due to your failure to secure your credentials

4.5 One Account Per Person

Each individual may maintain one personal account. Creating multiple accounts to circumvent limits, suspensions, or bans is prohibited and will result in permanent termination of all associated accounts.

5. Acceptable Use Policy

You agree to use GetGrowth only for lawful, legitimate business or creator purposes consistent with these Terms, applicable law, and the terms of any Connected Platforms. You are responsible for all activity that occurs under your account.

Acceptable uses include:

  • Automating genuine engagement with your own followers and audience
  • Publishing original, legally-owned content on your own social media profiles
  • Capturing leads from users who have voluntarily engaged with your content
  • Selling your own digital products and services to your audience
  • Managing client accounts as a social media agency (Agency plan)

6. Prohibited Conduct

The following uses are strictly prohibited. Violation of any item in this section may result in immediate account suspension or termination without refund.

6.1 Illegal Activity

  • Using the Service for any purpose that violates applicable local, national, or international law or regulation
  • Engaging in fraud, phishing, identity theft, or financial scams of any kind
  • Sending unsolicited commercial messages (spam) to users who have not opted in
  • Violating consumer protection, anti-spam, or telemarketing laws in any jurisdiction (including India's TRAI regulations, the US CAN-SPAM Act, Canada's CASL, or the EU's ePrivacy Directive)
  • Processing or transmitting content that is illegal under applicable law, including content that promotes violence, terrorism, or hate crimes

6.2 Platform Terms Violations

  • Using GetGrowth in a way that violates the terms of service, policies, or guidelines of any Connected Platform (Instagram, Facebook, WhatsApp, YouTube, LinkedIn)
  • Artificially inflating follower counts, likes, shares, or engagement metrics through inauthentic means
  • Engaging in coordinated inauthentic behaviour as defined by any platform
  • Accessing platform APIs beyond the permissions you have been granted

6.3 Harmful or Offensive Content

  • Publishing or sending content that is defamatory, harassing, threatening, or abusive toward any individual or group
  • Generating or distributing sexually explicit content involving minors
  • Inciting violence, discrimination, or hatred based on race, religion, gender, sexual orientation, nationality, disability, or any other protected characteristic
  • Publishing content that constitutes misinformation or deliberately false statements likely to cause harm

6.4 System Abuse

  • Attempting to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the Service
  • Introducing viruses, malware, ransomware, or any other harmful code into the Service
  • Conducting denial-of-service attacks or attempting to overwhelm our infrastructure
  • Scraping, crawling, or extracting data from the Service beyond what our API explicitly permits
  • Attempting to bypass, disable, or circumvent any security feature, rate limit, or access control within the Service
  • Using automated tools to access the Service in a manner that exceeds normal usage or interferes with other users

6.5 Resale & Unauthorised Commercial Use

  • Reselling, sublicensing, or otherwise commercialising the Service without a written agreement with GetGrowth (Agency plan holders may manage clients within the scope of their plan)
  • Using the Service to build a competing product or service
  • Representing that you are affiliated with GetGrowth or acting on our behalf without written authorisation

7. Platform & Third-Party Compliance

GetGrowth operates by connecting to third-party social media platforms via their official APIs. Your use of the Service is subject not only to these Terms but also to the terms and policies of each Connected Platform.

You are solely responsible for ensuring your automations comply with the rules of each platform. GetGrowth is not responsible for account suspensions, bans, or penalties imposed by third-party platforms as a result of your use of the Service. Platform policies change frequently — it is your responsibility to stay informed.

GetGrowth complies with all API developer policies of Connected Platforms and will promptly disable features that are found to violate platform rules. In such cases, we will notify you and, where possible, provide an alternative.

8. Content: Ownership & Responsibility

8.1 Your Content

You retain full ownership of all User Content you provide to GetGrowth — including your posts, persona prompts, digital products, branding, and templates. By using the Service, you grant GetGrowth a limited, non-exclusive, royalty-free licence to store, process, and use your User Content solely to provide the Service to you. We will not use your content for any other purpose without your consent.

8.2 Generated Content

Content generated by GetGrowth's automation on your behalf ("Generated Content") — including AI-written posts, replies, and messages — is owned by you upon creation, subject to any applicable third-party terms from underlying AI providers. You are fully responsible for all Generated Content published under your account, including its accuracy, legality, and appropriateness.

8.3 Content Warranties

By submitting User Content or publishing Generated Content through the Service, you represent and warrant that:

  • You own or have the necessary rights to all User Content you provide
  • Your content does not infringe any third party's intellectual property, privacy, or other rights
  • Your content does not violate any applicable law, regulation, or platform policy
  • You have obtained all necessary consents from individuals whose information appears in your content

8.4 Content Review

We do not proactively monitor or review the content published through your automations. However, we reserve the right to remove or disable access to any User Content or Generated Content that we determine, in our sole discretion, violates these Terms, applicable law, or third-party platform policies. We will notify you of such action unless prohibited by law.

9. Automation & Generated Content

9.1 Your Responsibility for Automations

You configure your automations and define the triggers, messages, and workflows within them. You are wholly responsible for how your automations behave and the impact they have on your audience. GetGrowth executes automations as instructed — we are the tool, you are the operator.

9.2 Accuracy of Generated Content

GetGrowth uses large language model (LLM) technology to generate posts and messages. While we work to produce high-quality, contextually appropriate output, we do not guarantee the accuracy, completeness, or suitability of any Generated Content. Generated Content may contain errors, outdated information, or outputs that do not reflect your intended meaning. You should review Generated Content — especially for sensitive topics, product claims, or legally significant statements — before it is published.

9.3 No Professional Advice

Generated Content does not constitute legal, financial, medical, or any other professional advice. Do not configure automations to provide such advice to your audience. GetGrowth bears no responsibility for decisions made by your audience based on Generated Content.

9.4 Lead Capture & Messaging Consent

When using GetGrowth to capture leads and send WhatsApp or other messages to your audience, you are responsible for ensuring that:

  • All message recipients have opted in through a verifiable action (e.g., commenting a keyword, subscribing to your content)
  • Every outbound sequence includes a clear opt-out mechanism (GetGrowth's built-in "STOP" feature satisfies this)
  • You comply with anti-spam and messaging consent laws applicable in your jurisdiction and the jurisdiction of your audience, including India's TRAI regulations, the EU's ePrivacy Directive, Canada's CASL, the US CAN-SPAM and TCPA, and equivalents in other countries

10. Subscriptions & Billing

10.1 Plans

GetGrowth offers the following subscription tiers. Features and limits for each plan are described on the Pricing page, which is incorporated into these Terms by reference.

Starter
Entry-level plan with basic automation features for creators getting started. Limited DMs and platforms.
Creator Pro
Full-featured plan with all 5 platforms, LinkedIn AutoPilot, lead magnets, and persona training. Most popular.
Agency
Multi-client plan for agencies with white-label branding, 20 client workspaces, and unlimited automations.

10.2 Billing Cycle

  • Subscriptions are billed on a monthly or annual basis, as selected at signup
  • Your billing cycle begins on the date your paid subscription activates
  • Annual subscriptions are billed upfront for the full year and receive a discount compared to the equivalent monthly rate
  • Subscriptions automatically renew at the end of each billing period unless cancelled

10.3 Payment Processing

All payments are processed securely by Cashfree Payments, a PCI-DSS Level 1 certified payment gateway. Accepted payment methods include UPI, debit cards, credit cards (Visa, Mastercard, Rupay, Amex), net banking, and supported digital wallets. GetGrowth does not store your card or banking details — all payment data is handled by Cashfree.

10.4 Price Changes

We reserve the right to change subscription pricing at any time. For existing subscribers, we will provide at least 30 days' written notice by email before a price increase takes effect. Continued use of the Service after the effective date constitutes acceptance of the new pricing. You may cancel your subscription before the new pricing takes effect if you do not accept the change.

10.5 Taxes

All prices are displayed exclusive of applicable taxes unless stated otherwise. Indian subscribers will be charged 18% GST on top of the listed price, as required by Indian tax law. International users may be subject to local sales tax, VAT, or equivalent, depending on their jurisdiction. You are responsible for any taxes applicable in your location beyond what GetGrowth is required to collect.

10.6 Failed Payments

If a payment fails, we will notify you by email and make up to three retry attempts over seven days. If payment is not received after three attempts, your account will be downgraded to a read-only state and automations will be paused. Your data will be retained for 30 days, during which you can reactivate by providing a valid payment method.

11. Refund Policy

We want you to be satisfied with GetGrowth. Our refund policy is as follows:

  • Within 7 days of initial payment: You are eligible for a full refund on your first subscription payment. Request by emailing admin@getgrowth.me with "Refund Request" in the subject line.
  • After 7 days: No refund is issued. You retain access to your paid plan until the end of the current billing period.
  • Annual subscriptions: Eligible for a prorated refund for the unused full months remaining if a refund request is made within 30 days of payment. After 30 days, no refund is available but access continues until the annual period expires.
  • First charge: The 7-day refund window applies from the date of your first charge.
  • Suspended accounts: If your account is suspended or terminated due to a violation of these Terms, you are not entitled to a refund for any unused portion of your subscription.

Refunds are processed within 7–10 business days back to your original payment method via Cashfree. Processing timelines depend on your bank or payment provider.

12. Discounts & Promotions

GetGrowth does not offer free trials. Exclusive discounts and promotional pricing may be available through our authorised partner Gencrafter. To enquire about a discount before subscribing, contact admin@getgrowth.me. The following conditions apply to any discount or promotional offer:

  • One discount per person and per organisation — duplicate claims are prohibited
  • Discounts apply to your first billing cycle only unless otherwise stated in writing
  • GetGrowth reserves the right to modify or discontinue any discount or promotional offer at any time
  • Abuse of promotional offers (e.g., creating multiple accounts to claim repeated discounts) may result in immediate account termination without refund

13. Intellectual Property

13.1 GetGrowth's IP

The Service, including its software, design, user interface, graphics, logos, trademarks, trade names, and all underlying technology, is the exclusive intellectual property of Block and Byte Technologies Pvt Ltd and is protected by copyright, trademark, patent, trade secret, and other applicable laws in India and internationally.

Nothing in these Terms transfers any ownership of GetGrowth's intellectual property to you. Your use of the Service grants you only a limited, non-exclusive, non-transferable, revocable licence to access and use the Service as permitted by these Terms.

13.2 Feedback

If you submit ideas, suggestions, or feedback about the Service ("Feedback"), you grant GetGrowth a perpetual, irrevocable, royalty-free licence to use, implement, modify, and commercialise that Feedback without any obligation to you. We are not required to treat Feedback as confidential.

13.3 Your Licence to GetGrowth

You grant GetGrowth a limited, non-exclusive, royalty-free licence to access, store, process, and use your User Content solely for the purpose of operating and providing the Service. This licence ends when you delete the relevant content or close your account, except where retention is required under these Terms or applicable law.

14. Confidentiality

Each party may have access to the other's confidential information in connection with these Terms. "Confidential Information" means any information disclosed by one party that is designated as confidential or that reasonably should be understood to be confidential given the nature of the information and the circumstances of disclosure.

Each party agrees to: (a) keep the other's Confidential Information strictly confidential; (b) not disclose it to any third party without prior written consent; and (c) use it only as necessary to fulfil obligations under these Terms.

Confidentiality obligations do not apply to information that: is or becomes publicly known through no breach of this section; was independently developed; or is required to be disclosed by law or court order, provided the disclosing party gives reasonable prior notice where permitted.

15. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GETGROWTH EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
  • ANY WARRANTY REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT, INCLUDING GENERATED CONTENT
  • ANY WARRANTY THAT YOUR USE OF THE SERVICE WILL ACHIEVE ANY PARTICULAR RESULT, INCLUDING FOLLOWER GROWTH, LEAD GENERATION, OR REVENUE OUTCOMES

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you. In such jurisdictions, our warranties are limited to the minimum permitted by law.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GETGROWTH, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, punitive, or exemplary damages
  • Loss of profits, revenue, data, goodwill, or business opportunities
  • Damages arising from changes to Connected Platform APIs, suspensions imposed by third-party platforms, or service interruptions caused by forces outside our reasonable control
  • Damages arising from the content of automated messages, posts, or replies generated or sent through your account
  • Losses arising from unauthorised access to your account due to your failure to maintain credential security

IN ALL CASES, GETGROWTH'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO GETGROWTH IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) INR 5,000 (FIVE THOUSAND RUPEES).

Some jurisdictions — including EU member states, the UK, and certain Indian consumer protection frameworks — do not allow the complete exclusion or limitation of consequential damages or liability for death and personal injury caused by negligence. In such jurisdictions, our liability is limited to the fullest extent permitted by law, and these limitations do not affect your statutory rights as a consumer.

17. Indemnification

You agree to defend, indemnify, and hold harmless GetGrowth and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, judgments, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of or access to the Service
  • Your User Content or Generated Content published through your account
  • Your violation of these Terms or any applicable law or regulation
  • Your violation of any third party's rights, including intellectual property rights, privacy rights, or platform terms
  • Any claim by a member of your audience relating to automated messages sent through your GetGrowth account

GetGrowth reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which event you will cooperate fully with GetGrowth in asserting any available defences.

18. Suspension & Termination

18.1 Termination by You

You may cancel your subscription and close your account at any time from your account dashboard. Upon cancellation:

  • Your paid access continues until the end of the current billing period
  • No further charges will be made after cancellation
  • Your data will be retained for 30 days after account closure, after which it will be permanently deleted (except where retention is required by law)
  • You may request immediate data deletion by emailing admin@getgrowth.me

18.2 Suspension or Termination by GetGrowth

We reserve the right to suspend, restrict, or terminate your account and access to the Service, with or without notice, if we determine in our reasonable judgement that:

  • You have violated these Terms, our Acceptable Use Policy, or any applicable law
  • Your use of the Service poses a risk to other users, third parties, or our infrastructure
  • Your account is being used to send spam, engage in fraud, or harm any individual
  • You have provided false or misleading information during registration
  • We are required to do so by law, regulation, or court order
  • Your account has been inactive for more than 12 consecutive months

For minor or first-time violations, we will generally attempt to provide notice and an opportunity to remedy the situation before suspension, except where the violation is severe or poses immediate harm.

18.3 Effect of Termination

Upon termination for any reason: all licences granted to you under these Terms immediately cease; your automations are disabled; your access to the platform is revoked. Provisions of these Terms that by their nature should survive termination — including ownership, disclaimers, indemnification, and limitation of liability — will survive.

19. Dispute Resolution

19.1 Informal Resolution First

Before initiating any formal legal proceeding, you agree to attempt to resolve any dispute with us informally by contacting admin@getgrowth.me with a written description of the dispute, your desired resolution, and your contact information. We will make good-faith efforts to resolve the dispute within 30 days.

19.2 Arbitration

If informal resolution fails, disputes shall be resolved by binding arbitration administered under the Arbitration and Conciliation Act, 1996 (India) by a sole arbitrator agreed upon by both parties, or appointed by the competent court in the absence of agreement. The seat and venue of arbitration shall be Bangalore, Karnataka, India. The language of arbitration shall be English. The arbitrator's decision shall be final and binding.

19.3 Consumer Rights Exemption

Nothing in this section limits your rights under applicable consumer protection laws. Users in the European Union retain the right to bring claims before their local courts as consumers. EU users may also use the EU Online Dispute Resolution platform. Users in India retain the right to approach consumer courts or the National Consumer Disputes Redressal Commission (NCDRC) as applicable.

19.4 Class Action Waiver

To the extent permitted by applicable law, you and GetGrowth each waive the right to participate in a class action lawsuit or class-wide arbitration. Each party may only bring claims in its individual capacity. This waiver does not apply in jurisdictions where class action waivers are unenforceable.

20. Governing Law & Jurisdiction

These Terms and any disputes arising out of or related to them or the Service shall be governed by and construed in accordance with the laws of the Republic of India, without regard to conflict of law principles.

Subject to the arbitration clause above, you consent to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India for the resolution of any disputes not subject to arbitration.

20.1 International Users

GetGrowth is operated from India. If you are accessing the Service from outside India, you do so on your own initiative and are responsible for compliance with local laws applicable in your jurisdiction. The following additional consumer-protection frameworks are acknowledged:

  • EU / EEA users: Your statutory rights as a consumer under EU law are not affected by these Terms. Mandatory local consumer protection laws apply to the extent they conflict with these Terms.
  • UK users: Your rights under UK consumer law (including the Consumer Rights Act 2015) are not excluded or limited by these Terms.
  • Australian users: Rights under the Australian Consumer Law (Competition and Consumer Act 2010) cannot be excluded and apply in addition to these Terms.
  • US users: Nothing in these Terms constitutes a waiver of any rights you have under applicable US state consumer protection statutes.

21. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

  • Update the "Last updated" date at the top of this page
  • Send a notification email to all registered users at least 14 days before changes take effect
  • Display a prominent notice within the GetGrowth dashboard
  • For changes that materially affect your rights or obligations, provide an option to accept the new Terms explicitly

If you continue to use the Service after the updated Terms take effect, you accept the revised Terms. If you do not agree with a change, your sole remedy is to cancel your subscription and stop using the Service before the effective date of the change.

22. General Provisions

22.1 Entire Agreement

These Terms, together with our Privacy Policy and any plan-specific terms incorporated by reference, constitute the entire agreement between you and GetGrowth with respect to the Service and supersede all prior or contemporaneous understandings, representations, or agreements.

22.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

22.3 No Waiver

Our failure to enforce any provision of these Terms at any time does not constitute a waiver of our right to enforce that provision in the future. A waiver of any right or remedy in one instance is not a waiver of any other right or remedy.

22.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. GetGrowth may assign these Terms, or any rights or obligations hereunder, without restriction — including in connection with a merger, acquisition, or sale of all or substantially all of our assets. Any prohibited assignment is null and void.

22.5 Force Majeure

GetGrowth is not liable for any failure or delay in performance of its obligations under these Terms arising from causes beyond its reasonable control, including acts of God, government restrictions, pandemics, war, civil unrest, internet outages, third-party service failures, or natural disasters.

22.6 Relationship of the Parties

Nothing in these Terms creates a partnership, joint venture, agency, franchise, or employment relationship between you and GetGrowth. You have no authority to bind GetGrowth to any obligation or act as its representative.

22.7 Language

These Terms are provided in English. If a translated version is made available for convenience, the English version shall govern in the event of any conflict.

22.8 Notices

Notices from GetGrowth to you will be sent to the email address associated with your account. Notices from you to GetGrowth must be sent to admin@getgrowth.me. Notices are deemed received: (a) when delivered, if sent by email with no bounce; or (b) two business days after sending, if sent by post.
